ICE agent charged with assault after 'pointing gun at people' while driving

An ICE agent has been charged with assault for allegedly pointing his gun at people in a car after pulling alongside them on a major road in Minneapolis.

An agent with U.S. Immigration and Customs Enforcement is facing felony assault charges after allegedly pointing his firearm at two people during a road rage incident in Minneapolis. Gregory Donnell Morgan Jr., 35, of Temple Hills, Maryland, was charged in Hennepin County with two counts of second-degree assault with a dangerous weapon on April 16, 2026. A nationwide warrant has been issued for his arrest. The charges stem from a February 5 incident on Highway 62, where Morgan, who was driving an unmarked Ford Expedition, is accused of brandishing his service weapon at the occupants of another vehicle.

According to the criminal complaint, the incident unfolded after Morgan was driving illegally on the shoulder to bypass traffic. The other driver told investigators they briefly moved in front of Morgan's vehicle to "cut him off" in an attempt to stop him from driving on the shoulder. After the driver moved back into the traffic lane, Morgan allegedly pulled up alongside their car, rolled down his window, and pointed a black handgun at the two occupants. The victims, who were not aware that Morgan was a law enforcement officer, called 911 to report what they perceived as a "crazy person driving down the road aiming guns at people."

In a voluntary interview with the Minnesota State Patrol following the incident, Morgan admitted to driving the rented SUV and drawing his firearm. He stated that he was conducting surveillance for ICE and feared for his safety when the other vehicle cut him off, prompting him to yell "Police Stop" as he brandished his weapon. However, the occupants of the other car said they did not hear him. At the time of the incident, Morgan and his partner were reportedly on their way back to the Whipple Federal Building to end their shift.

The charges against Morgan are the first to be filed against a federal officer involved in "Operation Metro Surge," a significant deployment of federal agents in the Twin Cities area. Hennepin County Attorney Mary Moriarty stated that the agent's actions were "extremely dangerous" and outside the scope of a federal officer's authority. She emphasized that there is no absolute immunity for federal agents who violate state laws. Second-degree assault with a weapon carries a presumptive prison sentence of three years in Minnesota.

The incident and subsequent charges have drawn further attention to the activities of federal agents in the Minneapolis area. Moriarty's office has been looking into multiple incidents of alleged illegal activity by federal personnel. As of the announcement of the charges, Morgan's employment status with ICE was unclear, and the Department of Homeland Security had not issued a public comment on the matter. The case will now proceed through the state court system, although as a federal agent, Morgan could petition to have the case moved to federal court.
